Civio, Inc. Privacy Policy

Civio, Inc. (“Civio”) is committed to protecting the privacy and security of its Customers (“Customers”), their employees, consultants, contractors, agents, Customers, donors, or other individuals who have agreed to comply with the Civio Online Terms of Service located on www.civio.com and have been supplied User identifications and passwords by Company (or by Civio at Company’s request) (“Users”) and all individuals who access and use the Civio site currently located at www.civio.com and its associated websites, applications and services (the “Service”)
There is a dynamic tension between Civio’s business purpose (helping its Customers and their Users to mobilize people) and individual privacy (the right of people to seclude themselves, or seclude information about themselves). This privacy policy (the “Civio Privacy Policy”) explains how we balance these two important but competing goals.

Ownership and Control of Customer Information

Each Civio Customer owns all of the information uploaded by it or its Users into the Service, which may include without limitation Individual Information (as defined below) (“Customer Data”). Civio stores and processes Customer Data in order to provide its service to its Customers and their Users. Each Customer is responsible for defining and enforcing its own privacy policy and best practices to secure that information. Civio provides Customers with tools to help manage Customer’s privacy policy and security practices, and to control User access to information, via role-based permission, privacy and application settings for Users.

User Account Information

2.1. User Account Creation. Every User must have a User account (“User Account”) to access and use Service. Customers are responsible for the actions of their Users and for providing User logins. Civio collects some personal information when each User creates a User Account, including, without limitation, a User name, an email address and a password. User names must be the actual first and last name of the User, separated by a space (e.g. “John Smith”).
2.2. Display of User Names. Civio displays User names to other Users within individual campaigns.

3. Collection of Information

3.1 User Provided Information. The Service is designed to collect and store information that can be directly associated with a specific person (“Individual Information”), including without limitation name, address, phone number, email, log-in information, contact history, demographic information, preferences, volunteer information, professional information and affiliations.
3.2. Automatically Collected Information. The servers hosting the Service automatically record certain information about any use of Service, including, without limitation, account activity (e.g., storage usage, number of log-ins, actions taken), data displayed or clicked on (e.g., UI elements, links), and other log information (e.g., browser type, IP address, page hits, date and time of access, cookie ID, referrer URL).
3.3 Cookies. Service uses cookies. A “cookie” is a tiny text file that is stored on an individual computer to customize the User’s experience and support some necessary functions. Civio also uses cookies to better understand how Customers and Users use Service. Civio’s cookies contain no Individual Information and are neither shared nor revealed and do not look for or at other sites’ cookies on individual computers. Users can modify their browser preferences to accept all cookies, receive notice when a cookie is set, or reject all cookies (To learn more about how to block or filter cookies, see http://www.cookiecentral.com/faq). Users who reject some or all cookies may modify or limit their experience of Civio’s website and other sites on the Web, including interfering with personalized content delivery offered by Civio or other Web sites.
3.4 Webpage Tags. Civio may use pixel tags (also known as Web beacons or clear GIF files) or other tracking technology to help monitor the User experience and to analyze and measure the effectiveness of online content and the general usage patterns of Service. The information that Civio collects using these pixel tags and similar technology is anonymous and contains no Individual Information.
3.5. Web Crawlers. Unlike most sites on the Web, Civio uses reasonable efforts to limit access to site information by third-party search engine “crawlers” (e.g. Google, Yahoo, MSN, Ask) including without limitation log-in controls.

4. Use and Disclosure of Information

4.1 Use of Customer Data. Civio uses the Customer Data to provide to its Customers and Users all of the features and services found on the Service. Civio will use a User’s email address, without further consent, for non-marketing or administrative purposes such as notifying a User of major site updates.
4.2 Use of Individual Information. Customers can access Individual Information to identify, contact and engage people, and Users can access Individual Information only as directed by Customers. Customers and Users may not use Individual Information for any other purpose.
4.3 Use of Automatically Collected and Cookies Information. Civio may use automatically collected information and cookies information to: (a) remember User information so that Users will not have to re-enter it during the User’s visit or the next time the User logs-in to the Service; (b) monitor the effectiveness of our marketing campaigns; and (c) monitor aggregate usage metrics such as total number of visitors and pages viewed.
4.4 Civio Hosting Providers. Civio may provide information to its hosting and service providers to help provide the greatest value to its Customers and their Users. Specifically, we may use third parties to host the service at a co-location facility for servers, to provide email and messaging services, to remove repetitive information from lists, to process payments, or to provide search results or links. In connection with these offerings and business operations, Civio’s service providers may have access to Customer and User information and Individual Information for a limited time in connection with these business and operational activities.
4.5. Disclosure to Law Enforcement Agencies. Civio may be required to disclose Customer or User information or Individual Information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. Civio does not reveal information until Civio has a good-faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, Civio may share information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through Service or using the Civio name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.
4.6 Disclosure in the Event of a Bankruptcy, Merger or Sale. If Civio should ever file for bankruptcy or have its assets sold to or merge with another entity, information Civio receives from Customer or Users through the Service may be transferred.

5. Children’s Privacy

5.1. Children’s Privacy. Consistent with the Children’s Online Privacy Protection Act of 1998 (COPPA), Civio does not knowingly contact or collect personal information from children under 13. The Service is not provided to Customers or their Users to solicit information of any kind from children under 13 or to contact children under 13.
5.2. Fraud and Deception. It is possible that by fraud or deception Civio may receive information about children under 13. If Civio is notified of such fraud or deception, as soon as it is verified Civio will immediately delete the applicable information from our servers. If you want to notify Civio about alleged or actual receipt of information about or from children under 13, please do so by emailing the information to privacy@civio.com.

6. Security

6.1. Security. No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, Civio cannot ensure or warrant the security of any information Users transmit to Civio and Users do so at their own risk. Civio takes reasonable precautions to protect Customer and User information and Individual Information.
6.2. Insecure Transmissions. Because email, SMS text messaging, instant messaging and social media messaging are not recognized as secure communications, Civio recommends that Customers and their Users not send private information by these methods.
6.3. Report Unauthorized Access. Customers’ and Users’ own efforts to protect against unauthorized access play an important role in protecting the security of Customer Data. Users should be sure to sign off when finished using a shared computer, and always log out of any site when viewing Individual Information.
6.4. Third-Party Websites. Civio may contain links to third-party websites that Civio does not control. Civio is not responsible for the content or privacy policies of these sites, and Users should check those policies on such sites prior to use of such sites.
6.5 Civio Hosting Providers. Where Civio utilizes third parties for processing any information, Civio implements reasonable contractual and technical protections that limit the use of that information to uses specified by Civio.

7. Special Note to International Users

The Service is hosted in the United States. If you are a User accessing the Service from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please note that you are transferring your personal data to the United States which does not have the same data protection laws as the EU and other regions, and by providing your personal data you consent to:

8. Terms of Use, Notices and Revisions

8.1. Terms of Use. Use of the Service, and any disputes arising from it, is subject to this Privacy Policy as well as the Civio Terms of Use and all of its dispute resolution provisions, including limitations on damages and choice of law and venue.
8.2. Notices and Revisions to Privacy Policy. Civio will revise or update this policy if its practices change, or as it develops better ways to keep Customers and User informed about them. Customers should refer back to the Civio Terms of Service for updates and for the latest information and the effective date of any changes. If Civio decides to change this policy, Civio will post a new policy on its website and change the date at the policy page. Non-material changes and clarifications will take effect immediately, and material changes will take effect within 30 days of posting on the website. Civio encourages Customers and Users to refer to this policy on an ongoing basis so that they understand Civio’s current privacy policy.
